    A few months later, one Hussein bin Mahmoud, a jurist of Sharia law for the Islamic State,  in an article published on February 17, 2015, and appearing in various jihadi websites, that all Christian churches in Cairo must be demolished. Titled the “Ruling on Egypt’s Christians,” the article, written like a fatwa, asserts:

    The ruling concerning the churches that are in Cairo is that they be destroyed, according to the consensus of the righteous forefathers, because they are new under Islam, and Cairo is a new city whose original inhabitants were Muslim; there were no churches in it previously.

    As for churches in Upper Egypt, which may have been in existence before the Islamic conquest of Egypt, these may remain but may never be renovated or fixed.

    All this is related to the mainstream Islamic view concerning non-Muslim places of worship: if they existed when Islam’s historic jihadis invaded the land, and if the native people surrendered peacefully, they may continue to exist (though never repaired); if, on the other hand, the native people resisted the invading Muslims, then all existing churches must be destroyed. In both cases, new churches are not allowed to be built.

    The issue of apostasy is very controversial for every religion and when it comes to Islam, the problem of leaving the faith gets almost the all shades of drama. There is no system of belief that welcomes apostasy as itself but Islam has dual approach to this term. According to positive and progressive Islam, Islam is set of rules and it should search for spiritual connections with people. There is no fear from God and human beings who dont want to accept Islam or who want to leave Islam are free to do it. One of moderate British imams, Ajmal Masroor, believes that apostasy is a free choice and that none should judge none. Unfortunately, there is another side of the coin and regressive backward streams of Islam leading by Shari’ah Law experts and radical imams who preach only about radical punishments for apostates.The spiritual leader of the Muslim Brotherhood of Egypt,  Sheikh Yusuf Al-Qaradawi often states that: “…if not for the threat of murder for anyone who leaves Islam, Islam would not exist today”.

    There is a huge misconception that I am progressively angrier about, largely because of the way it is wielded. It concerns 2:256, the famous Qur’anic verse that states ‘There is no compulsion in religion’, which is often quoted in part* and taken as evidence that Islam is tolerant of non-Muslims. .... The full context reveals that the verse is at least directly talking about faith and conviction rather than treatment of non-Muslims, making both a claim to the (purported) self-evidence of Islam and a rather self-evident point about how someone can’t be compelled to actually believe and it’s up to them to have faith, to choose the path of truth–being Islam here–over the path of error, a discussion that does not necessarily entail anything about how to treat those who don’t believe (though framing faith in Allah as the true path is itself already arguably judgmental of disbelievers). In short: while you can’t compel me to believe according to this verse…that doesn’t mean you can’t punish me if I don’t.

Calling Muhammad peaceful is like calling Genghis Khan a pacifist. They were both brutal men. No sugarcoating of history can change that.     This report surveys the apostasy laws of twenty-three countries in Africa, the Middle East, South Asia, and Southeast Asia. The survey primarily focuses on jurisdictions that make apostasy a capital offense. However, several countries that have adopted broadly-defined laws on blasphemy and insult to religion, which could potentially be used to prosecute persons for apostasy, have also been included, as well as one country that expressly prohibits extrajudicial punishment for allegations of apostasy. The countries surveyed that expressly make apostasy a capital offense are Afghanistan, Brunei, Mauritania, Qatar, Saudi Arabia, Sudan, the United Arab Emirates, and Yemen. However, only a small number of cases showing the application of these capital punishment laws were identified. Only two cases were identified that resulted in conviction for religious conversion— one in Iran in 1994 and another in Sudan in 2014. The country surveys also indicate that apostasy laws are frequently used to charge persons for acts other than conversion. For example, in Mauritania, Saudi Arabia, Jordan, and Yemen, individuals were charged with apostasy for their writings or comments made on social media. Of the countries researched, it appears that Iran is the only one that has executed a person convicted of apostasy to date

The refugee did not wish to be identified since he is regarded in Islamic theology as an apostate. It is unsurprising that this convert was arrested and beaten in the streets in Kurdistan; he was also preached about in a mosque there, and his father tried to kill him.

    Unfortunately, the plight of one minority being set upon – in particular, but not exclusively, by the Islamic State – has yet to become the subject of appropriate outrage around the world: Christians are being rounded up, raped, robbed and murdered by these and other jihadists across much of the Middle East. The Islamic State has even killed Christian children, just because of their faith. Typically, when IS jihadists conquer an area, they target Christian minorities by labeling their homes with the Arabic letter ن (pronounced “nun”), shorthand for the Arabic word Nasrani, which means Nazarene – a believer in Jesus of Nazareth and, therefore, a Christian. Once marked in this fashion, they are singled out for persecution, and given the simple choice – convert, submit or die.

    In the lands controlled by the Islamic State, the Arabic letter ن is the modern day version of the Star of David that Jews were forced to wear in Nazi Germany and the lands it conquered.

    The same week that Mr Yousaf was extolling the idea that Britain is a proto-Nazi state and Pakistan a potential safe-haven, the Pakistani authorities saw the latest round of the interminable and unforgivable saga of Asia Bibi. This is the woman who has been on death-row in Pakistan for no crime other than the crime of being a Christian. Bibi has been awaiting execution for five years, purely because a neighbour claimed that Bibi had insulted Mohammed during an argument.

    They attack the Conservative government of the UK for Nazism while not merely praising, but lauding as a safe haven, a state which actually persecutes and murders people because of their religion.

    Which means that he is doing what many other people today are doing, which is knowingly to cover for a racist despotism, so long as it is despotism with an Islamic face.

    Saudi blogger Raif Badawi is facing a new round of lashes, according to his supporters. A Canadian foundation campaigning for his release said a “reliable source” in Saudi Arabia told them he faces a renewed threat of flogging. The 32-year-old was handed 1,000 lashes and a ten-year jail term in 2014 for insulting Islam online. Mr Badawi received his first 50 lashes in public in January 2015, prompting international condemnation. Arrangements for his continued flogging have been postponed amid concerns for his health.

    This graphic description of this particularly brutal and horrible method of execution quotes the Iranian Penal Code. Iran has reportedly amended its internationally condemned law on stoning convicted adulterers to death to allow judges to impose a different form of execution in 2013:

    At least 150 people may have been stoned in Iran since 1980, the International Committees against Execution and Stoning said in 2010. 

    According to local media, MPs had removed stoning altogether from the bill that they adopted. But the hardline Guardians Council of clerics and jurists, which must approve all legislation before it enters into force, reinserted it, with the new amendment.

    However this document graphically illustrates the brutal and inhumane process for stoning under sharia law and several Islamic countries still have stoning as a method of execution for certain crimes, particularly adultery.

    Abstract Islam is more than a religion, it encompasses faith, culture, law and the social order. Islam proposes a society of righteousness and justice. Criminal behaviour is not tolerated in the Islamic order of society. Criminal behaviour is breach of God’s sovereignty, hence stiffer penalties are prescribed. This paper examines hudud punishments in Islamic penal system, and agitates for the reformation of Islamic criminal jurisprudence. While it is reasonable to punish offenders, and violators of normative principles, it is the opinion of this paper that punishments that are prescribed in municipal penal code should at least conform to international criminal jurisprudence.

    Civil liberties like freedom of thought, conscience and religion, and religious liberties are criminal offenses punishable under Hudud crimes in Islam. Criminal procedure under shariah does not allow cross-examination of witness, or rebuttal testimony by the accused. The rules of evidence in Islamic criminal law exclude all men who lack credibility, and integrity in society (non-adl).  Women and non-Muslims are not allowed to testify. There is no provision for jury trial, or appeals.

    Will Mainstream American Islam Condemn Pastor Nadarkhani's "Apostasy" Death Sentence? Where is CAIR? Where is the Islamic Society of North America? Almost 90 years ago, in his 1924 The Law of Apostasy in Islam, Samuel Zwemer made these observations, regarding the post World War I "Arab Spring" of that era:

    The story is told that Damocles, at the court of Dionysius of Sicily, pronounced the latter the happiest man on earth. When, however, Damocles was permitted to sit on the royal throne, he perceived a sword hanging by a horse-hair over his head. The imagined felicity vanished, and he begged Dionysius to remove him from his seat of peril. Today [circa 1924] we read of new mandatories, of liberty, and of promised equality to minorities under Moslem rule; and newspapers assert that a new era has come to the Near East. Economic development, intellectual awakening, reforms, constitutions, parliaments and promises Does the sword of Damocles, however, still hang over the head of each convert from Islam to Christianity? Is the new Islam more tolerant than the old? [emphasis added] Will the lives and property of converts be protected, and the rights of minorities be respected? ....Again and again has European pressure, aided by a few educated Orientals, endeavored to secure equality before the law for all religions and races in the Near East. But as often as the attempt was made it proved a failure, each new failure more ghastly than the last. The reason is that the conscience and the faith of the most sincere and upright Moslems are bound up with the Koran and the Traditions. [emphasis added] Civilization cannot eradicate deep-seated convictions. Rifles and ironclads, the cafe, the theatre, written constitutions, representative parliaments; none of these reach far below the surface. A truer freedom...than the one supplied by their own faith, must come before Moslems can enter into the larger liberty which we enjoy.

    How odd that a site that purports to give answers about Islam from learned imams would so misunderstand Islam as to think that apostates from Islam and those who say something impermissible about Islam should be put to death. Of course, there is no real misunderstanding here, but that is what Islamic apologists in the West would have us believe: that Islam is benign and completely compatible with Western principles of human rights, and only those who misunderstand it think otherwise.

    In any case, this ruling is pertinent today, as it explains why Muslims react with such fury and violence to perceived “insults” to Muhammad: in accord with his example, they consider verbal attacks on Islam even worse than physical ones, and believe that those who perpetrate such perceived attacks must be put to death. “Some of the rulings on apostasy and apostates,” fromIslam QA (thanks to Paul):

  • Summary: 

    The 1990 Cairo Declaration, or so-called "Universal Declaration of Human Rights in Islam", was drafted and subsequently ratified by all the Muslim member nations of the Organization of the Islamic Conference (OIC). Now a 57 state collective which includes every Islamic nation on earth, the OIC, currently headed by Turkey's Ekmeleddin Ihsanoglu, thus represents the entire Muslim umma (or global community of individual Muslims), and is the largest single voting bloc in the United Nations (UN). 

    Both the preamble and concluding articles (24 and 25) make plain that the OIC's Cairo Declaration is designed to supersede Western conceptions of human rights as enunciated, for example, in the US Bill of Rights, and the UN's 1948 Universal Declaration of Human Rights.

    The opening of the preamble to the Cairo Declaration repeats a Koranic injunction affirming Islamic supremacism, (Koran 3:110; "You are the best nation ever brought forth to men...you believe in Allah"), and states,

    "Reaffirming the civilizing and historical role of the Islamic Ummah which Allah made the best nation..."

    The preamble continues,

    "Believing that fundamental rights and universal freedoms in Islam are an integral part of the Islamic religion and that no one as a matter of principle has the right to suspend them in whole or in part or violate or ignore them in as much as they are binding divine commandments, which are contained in the Revealed Books of God and were sent through the last of His Prophets to complete the preceding divine messages thereby making their observance an act of worship and their neglect or violation an abominable sin, and accordingly every person is individually responsible  --  and the Ummah collectively responsible  --  for their safeguard."
