    The purpose of this article is to decipher the ominous, but heavily camouflaged language embedded within the English text of a recent scholarly document, published on the website of the Assembly of Muslim Jurists of America (AMJA), which is  Post-Election Statement: Principles and Roadmap (aka the Roadmap).

    As a 40-year specialist in the  of the  (GIM) and founding member of the Department of Homeland Security Customs and Border Protection (retired), my intention is to ‘pull out the threads’ of references in the Shariah-compliant Roadmap that are derived from the Quran and Hadith (and other academic sources), so that the general public sees more clearly that the AMJA is more than a simple ‘home-grown’ American Islamic organization.

    The demand for the abolition of sharia courts in Britain, as elsewhere, is not an attack on people's right to religion; it is a defence of human rights, especially since the imposition of sharia courts is a demand of Islamism to restrict citizens' rights.

    In our opinion, the Imams and Islamic scholars have failed to make the case that the jihad currently practised by ISIS and other groups is not sanctioned by Islamic texts. The critics have broken the very rules they accuse ISIS of not following when they try to make their case by ignoring abrogation and parts of Islamic texts that are inconvenient to their argument.

    They have also tried to substantially misrepresent the way Islam was spread after the initial conquest of the Arabian peninsular as been by defensive wars and peaceful invitations to people to become Muslims. The historical record shows a very different picture.

    Similarly with slavery, their claim that Islamic states have abolished it (under pressure from Western countries it must be said) is technically accurate, however slavery is still legal under Islamic Sharia law and it is still widely practised in several Islamic states. There is no will or movement in Islam that we are aware of to change Sharia law to abolish slavery and that such a movement is most unlikely to occur as Muhammad kept slaves himself and the Qur'an itself says that captured women may be used as sex-slaves:

    The critics have also implicitly endorsed the principle of Sharia hadd punishments provided correct [Islamic] procedure has been followed. That these senior figures of Islam, many in the West, who purport to be moderate implicitly endorse such punishments rather than flatly rejecting is troubling.

    The most troubling aspect however is that a multitude of senior Islamic figures are unable to make clear and unambiguous case against Islamic jihad and an Islamic caliphate that all, Muslim and non-Muslim alike, can clearly understand. The truth is that this letter appears to be mostly a public relations exercise designed to quiet growing Western fears regarding Islam. To that end, this letter is just another example of 'jihad by the pen' and one our governments have been quietly complicit in since 9/11 as this makes clear.

    We are fortunate to live in a democracy which enshrines the principle of equality before the law and is committed to the promotion of gender equality.  However, there are increasing concerns that many women and girls in this country are suffering from systematic gender discrimination.  The Arbitration and Mediation Services (Equality) Bill has been introduced in an attempt to highlight this unacceptable situation.  The Bill seeks to address two interrelated issues: the suffering of women oppressed by religiously-sanctioned gender discrimination; and a rapidly developing alternative quasi-legal system which undermines the fundamental principle of one law for all.  It provides a remedy for women who do not want to submit to discriminatory rulings, whether by formal arbitration proceedings, informal mediations or pseudocourts.  While the Bill does not specify any faith tradition, it has specific relevance for Muslim women who are adversely affected by the policies of Sharia Councils and Courts, with particular reference, for example, to discriminatory inheritance provisions, polygamy, access to divorce and domestic violence.  It also seeks to address widespread concerns about the situation for women who do not know their legal rights under British law and/or who are pressured by family or the community to adopt the provisions of Sharia law, which may cause them deep distress.  Although such concerns have sparked lively discussions across Europe, the Bill only extends to England and Wales.  The Bill does not interfere in the internal theological affairs of religious groups. In a free society, and in accordance with the hard-fought tradition of freedom of religion and belief, individuals must be able to organise their affairs according to their own principles, whether religious or otherwise.  However, attempting to operate a parallel legal jurisdiction and to allow the de facto creation of new legal structures and standards is unacceptable.

    Recent news of an Islamic “sharia court” in the Dallas area raised alarms but once , and  reporters accepted sharia judge assurances that the tribunal is essentially just mediating marital and contract disputes, alarm subsided. However, since the Islamic Tribunal  announces that the Dallas sharia center is a model and will serve to “set a precedence (sic) that will be emulated and duplicated throughout the country,” Americans should persist in getting answers to some deeper questions before assenting to a sharia tribunal franchise. If sister sharia “councils” in the UK and the EU are instructive, this tribunal’s protestations that proceedings comply with the law of the land are false.

    A few months later, one Hussein bin Mahmoud, a jurist of Sharia law for the Islamic State,  in an article published on February 17, 2015, and appearing in various jihadi websites, that all Christian churches in Cairo must be demolished. Titled the “Ruling on Egypt’s Christians,” the article, written like a fatwa, asserts:

    The ruling concerning the churches that are in Cairo is that they be destroyed, according to the consensus of the righteous forefathers, because they are new under Islam, and Cairo is a new city whose original inhabitants were Muslim; there were no churches in it previously.

    As for churches in Upper Egypt, which may have been in existence before the Islamic conquest of Egypt, these may remain but may never be renovated or fixed.

    All this is related to the mainstream Islamic view concerning non-Muslim places of worship: if they existed when Islam’s historic jihadis invaded the land, and if the native people surrendered peacefully, they may continue to exist (though never repaired); if, on the other hand, the native people resisted the invading Muslims, then all existing churches must be destroyed. In both cases, new churches are not allowed to be built.

    With regard to the main grounds for dissolution, these could be classified into three main groups:

    (i) a plurality of legal systems cannot be considered compatible with the Convention system, as it would introduce a distinction between individuals based on religion and thus, firstly, do away with the Stateís role as the guarantor of individual rights and freedoms and the impartial organiser of the practice of different religions and beliefs and, secondly, create an unacceptable discrimination;

    (ii) as to the application of sharia within the context of such a plurality of systems, explicitly proposed in certain of the statements referred to, the Court accepted the Constitutional Courtís conclusion that these statements formed a whole and gave a clear picture of a model proposed by Refah of a state and society organised according to religious rules; however, sharia is incompatible with the fundamental principles of democracy, since principles such as pluralism in the political sphere and the constant evolution of public freedoms have no place in it and a regime based on sharia clearly diverges from Convention values; Contracting States may oppose political movements based on religious fundamentalism in the light of their historical experience, and taking into account the importance of the principle of secularism in Turkey the Constitutional Court was justified in holding that Refahís policy of establishing sharia was incompatible with democracy;

    (iii) as to the relationship between sharia and the plurality of legal systems, Refahís policy was to apply some of shariaís private law rules to the Muslim population in the framework of a plurality of legal systems; however, such a policy goes beyond the freedom of individuals to observe the precepts of their religion and falls outside the private sphere to which Turkey confines religion, thus suffering from the same contradictions with the Convention system as the introduction of sharia; freedom of religion, including freedom to manifest religion, is primarily a matter of individual conscience and the sphere of individual conscience is quite different from the field of private law, which concerns the organisation and functioning of society ñ it had not been disputed that in Turkey everyone can observe in his private life the requirements of his religion but on the other hand any State may legitimately prevent the application within its jurisdiction of private law rules of religious inspiration prejudicial to public order and the values of democracy;

    • Mass migration from the Muslim world is fast-tracking the Islamization of Germany, as evidenced by the proliferation of no-go zones, Sharia courts, polygamy and child marriages. Mass migration has also been responsible for a host of social disruptions, including jihadist attacks, a migrant rape epidemic, a public health crisis, rising crime and a rush by German citizens to purchase weapons for self-defense — and even to abandon Germany altogether.

    • A Cologne police superintendent revealed that he was ordered to remove the term "rape" from an internal police report about the mass sexual assaults in Cologne on New Year's Eve. He said that an official at the North-Rhine Westphalia Interior Ministry told him in an angry tone: "This is not rape. Remove this term from your report. Submit a new report."

    • The German branch of Open Doors, a non-governmental organization supporting persecuted Christians, reported that thousands of Christians in German refugee shelters are being persecuted by Muslims, sometimes even by their security guards.

    • A 23-year-old Iraqi asylum seeker wearing a T-shirt with the words "I'm Muslim Don't Panic" was assaulted by fellow refugees for offending Islam. He was beaten so badly that he was hospitalized.

    • Half of the three million ethnic Turks living in Germany believe it is more important to follow Islamic Sharia law than German law if the two are in conflict, according to a survey.

    • A document leaked to Der Spiegel revealed that more than 33,000 migrants who are supposed to be deported are still in Germany, being cared for by German taxpayers. Many of the migrants destroyed their passports and are believed to have lied about their countries of origin to make it impossible for them to be deported.

    • Migrants committed 142,500 crimes during the first six months of 2016, according to a report by the Federal Criminal Police Office. This is equivalent to 780 crimes committed by migrants every day, or 32.5 crimes each hour, an increase of nearly 40% over 2015. The data includes only those crimes in which a migrant suspect has been caught.

    • Bild, the largest-circulation newspaper in Germany, warned that the country was "capitulating to Islamic law."

    Members of a government-funded Muslim anti-extremism organisation praised by the Prime Minister have been found to have made numerous anti-Semitic and homophobic comments on social media.

    The Birmingham-based charity Odara is believed to have received over £150,000 of taxpayer money via the government’s counter-extremism Prevent program, for the work it does in running workshops for women. The charity prides itself on providing what it calls a ‘safe environment for discussion on issues like domestic violence, mental health and extremism’.

    • By Western standards, military rule is shunned as an oppressive form of government, but in the Islamic world it is the only buffer of protection from the tyranny of total sharia law that must be enforced by Islamic theocracies, such as those of Iran and Saudi Arabia.

    • The days of sacrificing the safety and security of citizens of the West for the sake of multiculturalism, are over. In order for multiculturalism to work, it must be a two-way street between people that share common values of respect of each other's culture. Unfortunately, the West did not get that from Islam.

    • It really does not matter what is "true Islam". That is something the Muslim world needs to deal with internally; it does not serve us in the West to try to evaluate what is "true Islam" and what is not.

    • Your religious leaders, whose salaries are paid by Islamic governments, stand before your media cameras and call on Muslims to stab, slam trucks, kill, rape and humiliate the kafir [non-Muslim] Jews, Christians and Pagans.

    • Islamic governments and terror groups are two peas in a pod, working together for the same goal: enforcing Allah's law, sharia, on the world. It is no secret that a Muslim head of state must rule by sharia and must conduct jihad against non-Muslims. Sharia law commands Muslim citizens to remove, by rebellion or assassination, any Muslim leader who does not abide by sharia and support jihadists.

    • As of today, the West must hold Islamic governments responsible for jihadist actions of their own terrorist citizens. Nothing happens in Muslim countries without the knowledge of their governments. If a Muslim government has no control of its citizens, it should be considered a rogue nation.

    • Bringing in unvetted refugees from Syria and Iraq is not an act of compassion, but gross negligence. Western governments have failed their citizens for too long in that respect and that will end today.

    • After all, why should cultures that loathe the West seek to live in the West? As President-elect Trump said, why should America -- or any country -- not allow in only immigrants who love us and who respect our laws and way of life?

    • Our doors will be reopened to citizens from Islamic nations only when Islamic governments prove to the world that they have fundamentally changed, that they have ended once and for all their obsessive jihadist propaganda and hate education prevalent in the Muslim world.

    • Until then, all kinds of visas from such troubled areas will be suspended, except for the few who would be properly vetted. Such actions will surely expedite the reformation of Islam and Islamic education in Muslim nations who are desperate to give us their excess unhappy population.

    In 2007 conducted by Policy Exchange revealed that 37% of British Muslims aged 16-24 said they would prefer to live under sharia than under British law, while a similar number of Muslims under 35 said they agreed with the sharia stipulation that anyone who converted from Islam to another faith should be executed.

    These findings not only clearly illustrate that attitudes to sharia are a key touchstone in defining radicalisation among British Muslims, they also point to a demographic time bomb in this respect. Previous estimates of the number of British Muslims who had been radicalised generally suggested between 13% and 15%. However, Policy Exchange’s research suggests that more than a third of Muslims aged under 35 have been radicalised. It is therefore essential that the new Government takes action both to undo the appeasement of the sharia agenda that took place under the previous Labour government and to  challenge young British Muslims that advocacy of sharia is a line that must not be crossed.

    The essential problem for the government is to find a way of defining a specific point that very clearly delineates the start of radicalisation and that can be used as a touchstone to assesses when British Muslims and Islamic organisations have crossed it. Sharia provides that point. It is both wholly incompatible with a number of important historic British values and its implementation on Muslim and non-Muslim alike is central to the ultimate aims of both violent and non-violent Islamists.     I originally wrote this as a reflection on how the decades of Muslims ethnically-cleansing gay areas in London were predictors for future Muslim terrorism directed against gays. Within a few months of the Orlando attack, where a Muslim killed 50 gay people in a nightclub, I realised that the Orlando attack had been normalised & more-or-less forgotten.     I am writing to raise serious concerns over the Home Affairs Select Committee hearing on 1 November 2016 at which I gave oral testimony and to provide further and new evidence on the matter at hand, particularly with regards the transnational Islamist links with Sharia courts as well as the discriminatory content and intent of the courts, which violate the UK's gender equality obligations and commitments to freedom of religion and expression. Please treat this letter as a submission to the inquiry.

    Key findings are:

    1)     Accusations of "anti-faith", “Islamophobia” and racism constitute an attempt to delegitimise the evidence of secular witnesses to the inquiry.

    2)     Sharia councils violate human rights.  Based on their own statements, Sharia councils consider themselves to be courts, giving rulings on Islamic law which they consider binding on all Muslims.

    3)     Sharia judges have made statements supporting the criminalising of blasphemy and apostasy and justifying the killing of apostates. The label of "apostate" carries grave risk of shunning, violence and death.

    4)     Challenging any aspect of Sharia court decisions may lead to threats and charges of blasphemy and apostasy in Britain and abroad.

    5)     Sharia court jurisprudence and practice violate every article of the Convention on the Elimination of Discrimination Against Women (CEDAW). In particular, they violate Article 16 on marriage and family relations. The concept of "zina" which criminalises sex outside marriage is key to understanding the operation of Sharia courts.

    6)     Secular values underpin human rights treaties on ending gender discrimination. They cannot be set aside in favour of religious discrimination.

    7)     CEDAW recommendations declare that the state must end parallel and customary legal systems as they violate women’s right to equality.

    8)     The law and not religion must be the key basis for securing justice for citizens and BME women.
