  • BBC - Tell The Truth About Sharia Law

    Summary: 

    Due to on-going government inquiries, the BBC has recently covered sharia councils in the UK.  During debates and discussion on the issue, BBC presenters did not mention the fact that sharia law has been declared, by the European Court of Human Rights, as "wholly incompatible" with human rights and democratic principles; due overwhelmingly to its treatment of women.  Nor has the BBC provided significant details about sharia law, such as that it allows men to use physical force against their wives, mothers have no rights over children, and a woman's word is worth less than a man's. 

    Moreover, secular or Islam-critical voices have not been included in these debates.  

    As licence-fee payers, we demand that the BBC provide complete coverage of this important matter and to fully inform the public.  We also demand that those who believe in a single democratic law for all are given every opportunity to object to sharia councils, for whatever reason, and that our voices be heard.  It is not for Muslims alone to determine whether or not the United Kingdom accommodates sharia law, or what form that should take.

    Two inquiries in to the use of sharia law in the UK are currently on-going; one such inquiry was ordered by Prime Minister Theresa May when she was Home Secretary, the other a Home Affairs Select Committee inquiry. Given this, the BBC has had cause to cover the issue of sharia law in recent weeks.

    BBC coverage of this topic has been both unbalanced and incomplete, with vital information excluded. Please address the following points.

    The Sharia is a process of applying the Sunna of Mohammed and the Koran to everyday needs. It is a method of enforcing every human to live a life just like Mohammed, down to the smallest detail.

    No country bases all of its laws on the Sharia because the Sharia is not sophisticated enough to work in a modern world.

    The UK government is conducting an inquiry into the operation of Sharia courts which is being boycotted by a number of women’s organisations because its remit is too narrow, and the panel of judges is not seen as ‘independent’ enough.

    Parallel to this, the Home Affairs Committee has also launched an inquiry into whether the principles of Sharia are compatible with British law.

    On 7 November, there will be a public seminar on "Sharia Law, Legal Pluralism and Access to Justice" 7-9pm at Committee Room 12 at the Houses of Parliament. Below, we publish the story of a woman Shagufta (not her real name) who spoke to the campaign group, One Law for All, and described how a brush with the Sharia courts ruined her life forever.

    Today I called for citizenship to be revoked from new residents who broke Australian law in order to comply with Sharia law during a speech in parliament on forced marriages. Political correctness should not stop Australia from upholding and enforcing Australian law, including for those who voluntarily came to Australia. Special consideration should be given to anyone who, having signed up to Australian Citizenship and Australian law, breaks that Australian law out of compliance with a foreign religious law, such as forcing a child into marriage or female genital mutilation. They should forfeit their citizenship and their residency and return to where Sharia is the law of the land because there is no room for Sharia law in Australia.

    David Cameron’s plans to issue sharia-compliant bonds open the way to Islamic law being enforced at the heart of government, a senior clergyman has warned. Dr Michael Nazir-Ali, the former bishop of Rochester, said proposals to make Britain the first non-Muslim country to sell a bond that complies with sharia could trigger a series of “unforeseen consequences”.

    No intelligent government should impair the right of free speech to placate people who falsely claim they are victims when often they are, in fact, aggressors.

    To the 57 members of the Organization of Islamic Cooperation, however, all human rights must first be based on Islamic religious law, Sharia: whatever is inside Sharia is a human right, whatever is outside Sharia is not a human right.

    Therefore, slavery or having sex with children or beating one's wife, or calling rapes that do not have four witnesses adultery the punishment for which is death, or a woman officially having half the worth of a man, are all "human rights."

    Soft jihad includes rewriting history as with the UNESCO vote claiming that ancient Biblical monuments such as Rachel's Tomb or the Cave of the Patriarchs are Islamic, when historically Islam did not even exist until the seventh century; migration to widen Islam (hijrah), as we are seeing now in Europe and Turkish threats to flood Germany with migrants; cultural penetration such as promoting Islam in school textbooks or tailoring curricula for "political correctness"; political and educational infiltration, as well as intimidation (soft jihad with the threat of hard jihad just underneath it).

    More regrettable is that these are so often done, as at UNESCO, with the help and complicity of the West.

    A mob of 150,000 Muslim protesters took to the streets on Friday in Jakarta, Indonesia, calling for the death penalty for the capital’s Christian governor. Clashes following the protest resulted in one death and another twelve people injured, according to Indonesian police. Islamist groups denounced Gov. Basuki “Ahok” Tjahaja Purnama for “insulting Islam,” after the governor suggested that a Qur’an verse allegedly prohibiting Muslims from voting for non-Muslim leaders is a lie. During the march, demonstrators carried signs demanding that the official be put to death for blasphemy.

    Unofficial and unregulated Sharia law bodies are operating “everywhere in the country” preforming marriages and handing out divorces, the head of a body set up to standardise the administration of Islamic law in the UK has told MPs. Dr Ahmad Al-Dubayan, chairman of UK Board of Sharia Councils, based in Regent’s Park Mosque in London, said it was impossible to know how many so-called sharia “councils” are operating in Britain. But in some cases self-styled sharia authorities are operating out of small shops “maybe hidden in the basement or somewhere”, he said.

    If sharia councils operated fully within UK law, they would still pose a profound cultural challenge, and even if they made no pretence at legal power, non-Muslims would still have every right to object to their malign influence. Even if every single participant in a sharia council was there voluntarily without coercion or social pressure, and even if every ruling and process complied with equality and human rights standards, non-Muslims would still have every right to protest the fragmentation of our legal system. How can there be integration if our secular legal system is openly rejected? Putting aside, for a moment, the many implications of sharia for Muslim women, the spread of these councils reeks of separatism – and an Islamist desire to state Islam's power in the physical and political realm.

    Maryam Namazie: Thank you for having me here. I represent One Law for All, a coalition of organisations that includes Southall Black Sisters, the Iranian and Kurdish Women’s Rights Organisation, the Centre for Secular Space and British Muslims for Secular Democracy, as well as other groups. We include Muslim and non-Muslim women who are working together on this issue. We believe that Sharia courts play a very negative role in the lives of women. We think that, in content and structure, they are discriminatory against women, and to try to find good or bad when the law itself discriminates against women is problematic. We think that women should have access to one secular law for all.

    If you look at the creation of the Sharia courts, they came in the mid-1980s. They are a result of the rise of the political Islamic movement internationally, the repercussions of which we have seen here in Britain and in Europe. If you talk to older women who were living in Britain prior to this period, none of them were required or pressured to go to Sharia court. There was no need for this sort of divorce. In the past they would get civil divorces, which are acceptable in Pakistan, Iran and elsewhere. In a sense, we see this as part of the rise of the Islamist movement. It is one of their projects to manage and control women. They created a problem, and then they came forward and pretended that Sharia courts were the solution to the problem that they had created. It is highly problematic.

    We need to look fundamentally at why women from minority backgrounds should have different rights and rules applied to them. Why are we not stressing one law for all? In any sort of religious law—not just Sharia courts but Beth Dins and any sort of parallel legal system where religious arbitration is at play—you will find that women are discriminated against because of the nature of these sorts of rules.

    Maryam Namazie: I also think that we can’t wait for reform and changes. That is an issue we need to think about. We need to protect women and we need to protect them right away. From my perspective and the coalition I work with, we think that parallel legal systems should be abolished.

    Q17 Mr Winnick: Abolished completely?

    Maryam Namazie: Abolished, because I think it will protect women more. I know some will say that that means that they will carry on underground. Well, domestic violence continues, but we still have laws against it. When the Government say very clearly that parallel legal systems are unacceptable, it helps to protect the most vulnerable. Some women go freely, they get their rights, but we are talking about the most vulnerable in our society

    One of the ways I have seen Muslim leaders promote Islam is by talking about the glory of the Islamic civilization. The Islamic empire is said to be a system of justice and responsible for everything good in the world. Very often when these claims are made the Western Christian civilization is criticised as corrupt and brutal. This approach to promoting Islam is successful for a few reasons:

    Most Westerners feel some shame over the history of their empires, and so when a speaker attacks Western culture they acknowledge these faults.
    Most Westerners have little knowledge of Islamic history, and so assume that what the Islamic leader says about the Islamic empire must be true.
    Hence in the study of Islam in the West, the dominant convention is that a critical approach is reserved for the Christian past but forbidden for the Muslim past. ... The net result is a romantic picture of the history of Islam avoiding and sometimes denying such issues as the jihadists’ slaughter and massive enslavement of traditional African believers.     In this article I invite you to begin to learn about Islam's involvement in slavery. Islam has had a major role in the history of slavery beginning with Muhammad, and taking slaves from Europe across to Indonesia and down into Africa. But unlike the Western empires, Islam has never apologised and feels no shame. In fact Muslim leaders boast of their empire as the "Golden Period" and hide its corruption and brutality.

    Women and Equalities Minister Justine Greening has said the Government is taking concerns around Sharia courts "extremely seriously" amid fresh calls to abolish them.
    Ms Greening did not rule out supporting legislation curtailing the powers of Sharia courts, also known as councils, which settle disputes using Islamic religious law.

    I was shocked to watch the live proceedings of the House of Representatives as covered by NTA2 and saw that the bill calling for the criminal aspects of Islamic Sharia law to be implemented in our legal system in Nigeria at the Federal and states passed the second reading on Thursday, October 28, 2016.

    I was even more shocked because even though there were many Christians in the House no one raised an objection!

    If Allaah enables the Muslim mujahideen to defeat kaafir enemies in war, then the men may be killed, ransomed, set free without ransom or enslaved. The choice between these four options is to be made by the ruler, according to what he thinks is the best course.

    With regard to the women, they become slaves and “those whom one's right hand possesses” (described as a “right hand servant” in the question). Male children also become slaves. The ruler shares out these slaves among the mujaahideen.

    Shaykh al-Shanqeeti (may Allaah have mercy on him) said: The reason why a person may be taken as a slave is his being a kaafir and waging war against Allaah and His Messenger. If Allaah enables the Muslims who are striving and sacrificing their lives and their wealth and all that Allaah has given them to make the word of Allaah supreme over the kaafirs, then He allows them to enslave the kuffaar when they capture them, unless the ruler chooses to free them or to ransom them, if that serves the interests of the Muslims.

    One of the UK’s leading sharia courts “protects wife-beating suspects by sabotaging criminal proceedings against them”, a Parliamentary committee has heard.
    The Muslim Arbitration Tribunal (MAT) in Nuneaton, Warwickshire, is just one of the UK’s 80 Islamic “councils”, set up in 2007 ostensibly to help resolve civil and family disputes in accordance with Islamic scripture.

    The late father of Huma Abedin, the devout Muslim who’s co-chairing Hillary Clinton’s presidential campaign, sympathized with the Barbary pirates in America’s first bout with Muslim terrorism and criticized President Thomas Jefferson for not appeasing them by paying their infidel tax.

    In a 1974 dissertation for his PhD at the University of Pennsylvania, Syed Z. Abedin slammed Jefferson, one of America’s most popular founding fathers, for raising a U.S. naval force and invading Tripoli during the Barbary Wars against Islamic pirates attacking U.S. ships in the early 1800s.

    Over several years, the Muslim extremists in North Africa had been firing on American merchant ships in the Mediterranean and killing crews and passengers, while taking survivors hostage. Jefferson received shocking reports from Algiers and Tripoli of mistreatment of captured American men and women who were turned into slaves of the Muslim states.

    Unfortunately, the plight of one minority being set upon – in particular, but not exclusively, by the Islamic State – has yet to become the subject of appropriate outrage around the world: Christians are being rounded up, raped, robbed and murdered by these and other jihadists across much of the Middle East. The Islamic State has even killed Christian children, just because of their faith. Typically, when IS jihadists conquer an area, they target Christian minorities by labeling their homes with the Arabic letter ن (pronounced “nun”), shorthand for the Arabic word Nasrani, which means Nazarene – a believer in Jesus of Nazareth and, therefore, a Christian. Once marked in this fashion, they are singled out for persecution, and given the simple choice – convert, submit or die.

    In the lands controlled by the Islamic State, the Arabic letter ن is the modern day version of the Star of David that Jews were forced to wear in Nazi Germany and the lands it conquered.

    We know that just like most religions, Islam can be interpreted radically, and we know that most Muslims do not support these interpretations. Nevertheless, when we observe that a staggering 27% of British Muslims3 sympathize with the Charlie Hebdo attackers, who were responsible for the deaths of 12 in Paris in January this year, we must earnestly ask ourselves how these fundamentalist world views prevail within our often integrated and contiguous communities. It is sometimes argued that answering a poll in favor of stoning does not necessarily mean that one is willing to exact the punishment themselves3, i.e. “saying” isn’t necessarily “doing”. This distinction is not as significant as some people may think; at the end of the day, masses can provide the ideological validation that legitimizes the extremist’s actions. As most Western Christians have done, Muslims need to recognize that grey lines can be exploited by radicals and evil-doers. Therefore, we must do away with ambiguous and unrealistically wishful ideas of progressive Islamic law.

    A: It makes you feel like a slave, a property that can never be treated as a normal human. I was lucky enough to have a father who is rarely home, so going out without his permission is pretty easy, i just have to deal with some reproach, so not too bad in my case.

    Q: What would you say to people who claim the problem is cultural- despite the fact there are hadiths of Muhammad to say women should only do certain things, like travel, as with a mahram?

    A: Islam IS their culture, they have nothing else, so both are to blame. People need to learn more about islam before making such ridiculous claims.

    Sharia law "courts" are already dealing with crime on the streets of London, it has emerged. The revelation came after the Archbishop of Canterbury, Dr Rowan Williams, called for an "accommodation" with parts of the Islamic legal code in a speech which attracted widespread condemnation. The Archbishop said parts of civil law could be dealt with under the sharia system but already some communities have gone much further - and it was revealed today that a teenage stabbing case among the Somali community in Woolwich had been dealt with by a sharia "trial".

They are anti-Christian, violent-minded Muslim groups who support Pakistan’s blasphemy laws and want to see this innocent Christian lady murdered in cold blood for a bogus blasphemy charge that she was given on the word of a group of Muslim women with whom she was having a dispute.

    Canada, like the US and other Western democracies, has been infiltrated by mainstream Muslim groups, leaders, speakers, imams, etc. who appear to be benign, but who are anti-West and anti-Israel, and habe the goal of doing dawah for the ultimate purpose of Sharia conquest.

    In an article originally published by Young Muslims website and entitled “Understanding Punishment in Shariah [Islamic Law], Taha Ghayyur explained the rationale behind the harsh punishments in Islam (execution, stoning, cutting off thieves’ hands etc.) and argued that the Islamic Law (Shariah) can be implemented in North America.

    Specifically troubling was that Ghayyur’s message was published for a Muslim youth audience.

    The Malaysian Parliament is set to debate a controversial bill that could see stricter forms of sharia law introduced in the state of Kelantan, but critics have warned the so called hudud bill would result in whippings and even the amputations of limbs for crimes such as theft. The Pan-Malaysian Islamic Party — commonly known as PAS — is pushing to introduce the proposed laws in the conservative north-eastern state, but first the bill must be passed by the Malaysian national parliament.

    Since it is extremely difficult to gain access to these tribunals, we have tried to show what sort of rulings they may give by referring to online sites used by mosques and individuals. It will at once be clear that the muftis who issue these fatwas walk a very fine line between legality and illegality and sometimes cross into territory where human rights are abused. It should be borne in mind that sharia rulings do not fluctuate by very much (though variants between muftis are far from uncommon). This principle, that it is obligatory to uphold the essential integrity of Islamic jurisprudence and the rulings that come from it, allows us to show in broad terms what muftis are ruling by referring to online sites that are referenced by some of the mosques in our list. The Appendix below provides a range of rulings gleaned from some of these sites, where archives are kept of past fatwas, together with the questions that prompted them. We have edited this material lightly in order to make it accessible to the non‐Muslim and non‐specialist.  

    Among the rulings in the Appendix, we find some that advise illegal actions and others that transgress human rights standards as they are applied by British court. Here are some examples: a Muslim woman may
    not under any circumstances marry a non‐Muslim man unless he converts to Islam; such a woman’s children will be separated from her until she marries a Muslim man; polygamous marriage (i.e. two to four wives) is considered legal; a man may divorce his wife without telling her about it, provided he does not seek to sleep with her; a husband has conjugal rights over his wife, and she should normally answer his summons to have sex (but she cannot summon him for the same reason); a woman may not stay with her husband if he leaves Islam; non‐Muslims may be deprived of their share in an inheritance; a divorce does not require witnesses (i.e. a man may divorce his wife and send her away even if no‐one else knows about it); re‐marriage requires the wife to marry, have sex with, and be divorced by another man; a wife has no property rights
    in the event of divorce (which may be initiated arbitrarily by her husband); sharia law must override the judgements of British courts; rights of child custody may differ from those in UK law; taking up residence in a non‐Muslim country except for limited reasons is forbidden; taking out insurance is prohibited, even if required by law; there is no requirement to register a marriage according to the law of the country; polygamy is acceptable, even if against the law; it is undesirable to rent an apartment belonging to a Christian church; a Muslim lawyer has to act contrary to UK law where it contradicts sharia; employment through driving a taxi is prohibited; it is allowable to be a police officer, provided one is not called upon to do anything contrary to sharia; women are restricted in leaving their homes and driving cars; an adult woman may not marry anyone she chooses; sharia law of legitimacy contradicts the Legitimacy Act 1976; a woman may not leave her home without her husband’s consent (which may constitute false imprisonment); legal adoption is forbidden; a man may coerce his wife to have sex; a woman may not retain custody of her child after seven (for a boy) or nine (for a girl); a civil marriage may be considered invalid; sharia law takes priority over secular law (e.g. a wife may not divorce her husband in a civil court); fighting the Americans and British is a religious duty; recommendation of severe punishments for homosexuals; a woman’s recourse to fertility treatment is disliked; a woman cannot marry without the presence (and permission) of a male guardian (the wali); a divorce is valid if the husband simply intends to do it; polygamous marriage should be maintained, even in the UK; if a woman’s ‘idda has expired and she no longer has marital relations with her husband, he is excused alimony payments; an illegitimate child may not inherit from his/her father.

    This graphic description of this particularly brutal and horrible method of execution quotes the Iranian Penal Code. Iran has reportedly amended its internationally condemned law on stoning convicted adulterers to death to allow judges to impose a different form of execution in 2013:

    At least 150 people may have been stoned in Iran since 1980, the International Committees against Execution and Stoning said in 2010. 

    According to local media, MPs had removed stoning altogether from the bill that they adopted. But the hardline Guardians Council of clerics and jurists, which must approve all legislation before it enters into force, reinserted it, with the new amendment.
